Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of Pogpin and our website. By creating an account or using the product, you agree to them. If you’re agreeing on behalf of a company, you confirm you’re allowed to bind it.

The deal

Pogpin gives you a tool to collect visual feedback pinned to live web pages. We grant you a non-exclusive, non-transferable right to use it according to your plan. You agree to use it lawfully and in line with these Terms. Simple.

Your account

• You’re responsible for keeping your login credentials secure.
• You’re responsible for activity under your account and for your team members’ use.
• You must give accurate information and keep it up to date.
• Tell us promptly if you suspect unauthorised access.

Guests leaving feedback don’t need an account, but their use is still covered by the Acceptable use rules below.

Acceptable use

Don’t use Pogpin to:

• break the law or infringe anyone’s rights;
• upload malware, or probe, scrape or overload the service;
• harass, abuse, or post unlawful or hateful content;
• resell or white-label the service without our written agreement;
• reverse-engineer the product except where the law expressly allows it.

In plain English use it like a good neighbour. If what you’re doing would make someone’s day worse or our servers cry, don’t.

Your content & feedback

Everything you and your guests create in Pogpin — pins, comments, attachments — is your content. You keep all rights to it. You grant us a limited licence to host, store, process and display that content solely to operate and improve the service for you. We don’t claim ownership and we don’t sell it.

You’re responsible for making sure you have the rights to the content you submit, and that capturing feedback on a given site is something you’re permitted to do.

In plain English your pins are yours. Our licence exists only so we can show them back to you and your team. Leave, and you take your data with you.

Plans, billing & refunds

• Free stays free for solo work — no card required, within its stated limits.
• Paid plans (Starter, Pro, Agency, Enterprise) are billed in advance per the plan you pick, monthly or annually, and renew automatically until cancelled.
• Dodo Payments is our Merchant of Record: it is the seller of record for your purchase, handles the transaction, taxes and invoicing, and is what appears on your statement.
• Cancel anytime. You keep access through the end of the period you’ve already paid for; we don’t claw it back.
• Taxes may apply on top of listed prices depending on your location.
• Except where the law requires otherwise, payments are non-refundable — the Free plan is the trial. Duplicate charges, billing errors and charges after a cancellation are always refunded; the full detail is in our Refund Policy.

Our intellectual property

The Pogpin software, brand, logo and site design are ours (or our licensors’). These Terms don’t transfer any of that to you beyond the right to use the service. Don’t use our name or marks without permission.

Third-party integrations

When you connect a notification channel like Slack, Discord, Telegram, Microsoft Teams, Lark, Gotify, ntfy, Pushover or a custom webhook, your use of that service is governed by its terms, not ours. We’re not responsible for third-party services, and connecting them is your choice.

Availability & changes

We work hard to keep Pogpin up and fast, but we don’t promise uninterrupted service. We may update, add or remove features as the product evolves. For material changes that affect you, we’ll give reasonable notice.

Warranty disclaimer

Pogpin is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the maximum extent the law allows, Pogpin won’t be liable for indirect, incidental or consequential damages, or lost profits or data. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim (or US$100 if you’re on a free plan). Some jurisdictions don’t allow these limits, so parts may not apply to you.

Termination

You can stop using Pogpin and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the service in a way that risks harm. Where reasonable, we’ll warn you first and give you a chance to export your data.

Governing law

These Terms are governed by the laws applicable at Pogpin’s place of business, and disputes will be handled by the courts there, unless mandatory local consumer law gives you other rights.

Changes to these Terms

We may update these Terms from time to time. If we make a material change, we’ll update the date above and notify you in-app or by email. Continuing to use Pogpin after a change means you accept the new Terms.
